General Terms and Conditions (GTC)

1. Scope

   These General Terms and Conditions apply to all orders of digital products of the brands Soul Guide 427 and other guides (hereinafter referred to as “Products”) via the platform CopeCart GmbH, which acts as the seller.

   The rights holder and owner of the content as well as the brand is Oraya Ventures LLC (hereinafter referred to as “Rights Holder”).

2. Contractual Partners

   • Seller and contractual partner of the customer: CopeCart GmbH, Ufnaustraße 10, 10553 Berlin, Germany (hereinafter “CopeCart”).
   • Rights holder and brand owner: Oraya Ventures LLC, Wyoming, USA (hereinafter “Rights Holder”).

   The customer concludes the purchase contract for the Products with CopeCart. Oraya Ventures LLC provides the content and brand rights.

3. Subject of the Contract

   • The Products are exclusively digital and individually created based on the data provided by the customer.
   • Delivery is made solely via email in digital form.
   • No physical deliveries will take place.

4. Conclusion of Contract

   • The purchase contract is concluded via the CopeCart platform.
   • By completing the order and payment at CopeCart, the customer submits a binding offer.
   • The purchase contract is concluded with the order confirmation from CopeCart.

5. Prices and Payment Processing

   • The prices stated at the time of order apply.
   • Payment processing is carried out exclusively via CopeCart.
   • The Terms and Conditions of CopeCart apply in addition.

6. Delivery

   • Delivery is made solely digitally by email to the address provided by the customer.
   • As a rule, the Product is delivered within a few minutes, but no later than within 24 hours after receipt of payment.
   • The customer is responsible for providing a correct email address.

7. Right of Withdrawal

   As the Products are individually created and delivered immediately after ordering, there is no right of withdrawal or return (§ 312g para. 2 no. 1 and no. 6 German Civil Code). By placing the order, the customer expressly agrees that the execution of the contract begins immediately and that the right of withdrawal expires.

8. Disclaimer

   • The Products are intended for self-reflection, inspiration, and personal development.
   • They do not replace medical, psychological, or therapeutic advice.
   • Decisions the customer makes based on the Products are the customer’s own responsibility.
   • Any liability of the Rights Holder for damages resulting from the use of the Products is excluded, except in cases of intent or gross negligence.

9. Copyright & Use

   • All content, brands, designs, and Products are the intellectual property of Oraya Ventures LLC.
   • With the purchase, the customer receives a simple, non-transferable right of use for personal use only.
   • It is prohibited to copy, distribute, publish, or commercially use the content.

10. Data Protection

    • To create the Products, personal data such as name, date of birth, time of birth, and place of birth are processed.
    • This data is used solely for the purpose of product generation.
    • Further information can be found in the Privacy Policy.

11. Final Provisions

    • German law applies, as the contract is concluded with CopeCart.
    • The place of jurisdiction, insofar as permissible, is Berlin (Germany).
    • The General Terms and Conditions of CopeCart apply in addition.
    • If individual provisions of these GTC are invalid, the validity of the remaining provisions shall remain unaffected.

Cancellation Policy

Right of Withdrawal

Consumers generally have a right of withdrawal pursuant to § 355 German Civil Code. However, this right of withdrawal does not apply if one of the exceptions regulated in § 312g para. 2 German Civil Code applies.

According to § 312g para. 2 no. 1 and no. 6 German Civil Code, there is no right of withdrawal for the following contracts:

• Contracts for the supply of goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.
• Contracts for the supply of digital content not on a physical medium if the entrepreneur has begun performance of the contract after the consumer has expressly agreed that performance begins before the withdrawal period expires and has confirmed knowledge that this consent results in the loss of the right of withdrawal.

Exclusion of the Right of Withdrawal

The Products offered on our platform (“Soul Guide 427” and other guides) are individually created digital content, personalized based on the data provided by the customer (e.g., name, date of birth, time of birth, place of birth).

Therefore:

• By completing the order, the customer expressly agrees that CopeCart GmbH, as the seller, begins performance of the contract immediately.
• The customer confirms that by giving this consent, the right of withdrawal is lost.
• A withdrawal or return is therefore legally excluded.
